Yes: Gemini is a legitimate, regulated exchange, not a scam.

Gemini Trust Company LLC holds a New York limited-purpose trust charter from the New York State Department of Financial Services (NYDFS, the New York banking and financial regulator). That is a stricter authorisation than the money-transmitter licences most US crypto platforms hold.

A trust charter makes Gemini a fiduciary. It is legally required to hold your assets one-to-one and submit to bank-level examination by regulators.

The spot exchange (crypto bought and sold at current market price, without leverage) was never at risk during the Earn episode. Earn was a separate product that relied on an external counterparty, and its failure is not evidence of fraud at the exchange level.
